The Financial Services and Credit Panel is a group of industry participants appointed by the government to assist the Australian Securities & Investments Commission (ASIC) in administrative decision making by forming sitting panels to address potential misconduct by financial and credit advisers.
Each panel, comprising an ASIC staff member and at least two FSCP members, has powers to respond to misconduct, as outlined in relevant legislation and regulations. These powers include:
-
The power to direct financial advisers to undertake specified training, counselling, supervision, or report certain matters to ASIC.
-
The power to suspend or prohibit a financial adviser’s registration.
-
The power to issue infringement notices in specified circumstances.
-
The power to recommend that ASIC commence civil penalty proceedings.
-
The power to accept enforceable undertakings from financial advisers.
The sitting panel can hold administrative hearings and decide whether to make banning orders against individuals for misconduct in providing financial services to retail clients or engaging in credit activities.
Crellin was first appointed to the FSCP in 2022 and will now be on the panel for another three years, until 1 January 2028.
Noting his reappointment, the Resolve Finance MD took to LinkedIn to say he was: “Proud to have the opportunity to contribute back to our industry in supporting high standards and integrity in the mortgage broking sector. Look forward to working alongside other panel members to make a meaningful impact.”
He joins 23 other members of the finance industry on the panel, including risk advisers, insolvency specialists, compliance officers, and wealth advisers.
Announcing the panel reappointments, outgoing Financial Services Minister and Assistant Treasurer, Stephen Jones MP, said: “The candidates bring with them a range of knowledge and experience across the fields of business, administration of companies, financial markets, financial products and financial services, law, economics, accounting, taxation and credit activities and credit services.
“These reappointments will continue the high level of skills and experience available to the FSCP, to help ensure that key sectors of our economy are regulated effectively.”
